Rule 205
Motion for Proclamation of State of Emergency or Approval of Order
(1) In accordance with Article 273, Clause 1) of the Constitution, if the President issues a declaration or order of a state of emergency in the State of Nepal, the Prime Minister shall give notice of the related proposal to the Secretary General or, in his absence, to the Secretary within one month from the date of issuance of such declaration or order. (2) Sub-rule (1) In a meeting five days after receiving the notification of the announcement or order, the chairman shall set the day and time for submitting the proposal. (3) On the day and time specified in accordance with sub-rule (2), the Prime Minister, after taking the permission of the chairman, shall give a statement regarding the grounds and reasons for issuing the emergency declaration or order. The proposal will be submitted in the meeting. (4) After the proposal is submitted according to sub-rule (3), the chairman will set a time period to discuss the proposal. If the prime minister or the minister authorized by him is unable to attend due to unwellness or uncontrollable circumstances, the discussion will end after the answers to the questions raised during the discussion are given. The decision of the Assembly on the motion presented in accordance with sub-rule (1) shall be by division of votes with the signatures of the members. (7) If the Federal Parliament is not in session at the time of the issuance of the declaration or order as per sub-rule (1), the meeting shall be held within fifteen days at the most from the date of issuance of such declaration or order.
